Police said at about 11.45pm on Saturday, August 26 they spotted the 49-year-old Pindimar man’s car stopped at a 45 degree angle in Myall Street, Tea Gardens. Police said when they asked the man to step out of his car he fell onto the roadway and had to be helped back to his feet.

He was breath tested and allegedly recorded a reading of .285. Police said this was extremely high, as a blood alcohol reading of .300 meant a person was “clinically dead”. The man was taken to Tea Gardens Police Station but because of his inability to stand unassisted was not submitted to a further breath analysis. This meant he was charged with failing to submit to breath analysis which carries the same penalty as high-range drink driving. He was set to appear in Raymond Terrace Court on Monday, September 17.
